Is Labour Day a Paid Holiday in Jamaica?

Yes. Jamaica Labour Day (May 25) is a designated public holiday under the Public Holidays Act. Employees who would normally work that day are entitled to receive it as a paid day off at their regular rate.

This is not optional and does not require a special clause in employment contracts. It is the law.


If Your Employees Work on Labour Day

If you need staff to work on May 25, the rules are clear under the Holidays With Pay Act:

Employees working on Labour Day are entitled to:

  • Their normal day's pay (base rate), PLUS
  • An additional 50% premium (half of their daily rate)

In practice, this means you pay 1.5 times their normal daily rate total, or what is commonly called "time and a half."

Example: An employee earns J$25,000/week and works 5 days. Their daily rate is J$5,000.

  • Normal daily pay: J$5,000
  • Holiday premium: J$2,500 (50% of J$5,000)
  • Total for working Labour Day: J$7,500

Alternatively, some employers offer time-off-in-lieu (a substitute day off) instead of the premium pay. This is only valid if the employee agrees in writing in advance.


Part-Time Employees and Labour Day

The rules for part-time employees depend on their normal working pattern.

If the employee normally works on Mondays (since May 25, 2026 falls on a Monday): They are entitled to holiday pay — either a paid day off or 1.5x if they work.

If the employee does not normally work Mondays: No holiday pay obligation for that specific public holiday. However, if Labour Day falls on a day they do not regularly work, you cannot simply count it as one of their annual leave days.

Track your part-time staff schedules carefully. This is one of the most common sources of labour disputes in Jamaica.


Casual Workers and Labour Day

The Holidays With Pay Act does not automatically cover casual workers. However, "casual" in Jamaica law has a specific meaning — it means genuinely irregular work with no expectation of continued employment.

If someone works for you regularly every week but is classified as casual, a court or the Ministry of Labour may determine they are actually an employee entitled to holiday pay. When in doubt, consult an employment attorney.


How to Process Labour Day in Payroll

If your payroll runs weekly and Labour Day falls in the middle of a pay week:

  1. Flag May 25 as a public holiday in your payroll system
  2. For employees who had the day off: pay normal daily rate for that day
  3. For employees who worked: add the 0.5x premium to their weekly total
  4. Confirm payslips reflect the correct amounts before issuing
